2. Personal information we collect
We only collect information you voluntarily provide through our forms, along with certain technical data required for the site to function.
Quote form ("/soumission")
- Full name
- Company name (optional)
- Email address
- Phone number
- Job site address and city
- Project type and preferred date
- Message and project details
Thermik Pro partner application ("/thermik-pro/adhesion")
- Legal and commercial name
- RBQ license number, year founded, address, postal code
- Website, number of employees
- Activity types, service areas, project volume
- Current spray foam usage, subcontractors, challenges encountered
- Name, title, email and phone of primary contact
- Motivation to join the program and additional comments
Automatic technical data
- IP address (used only for abuse-prevention rate limiting)
- Submission date and time
- Browser type and operating system (standard server logs)
3. Purposes of collection
Your personal information is used only for the following purposes:
- Respond to your quote or information requests
- Evaluate your application to the Thermik Pro partner program
- Contact you to follow up, schedule a visit, or provide an estimate
- Establish, maintain and manage a business relationship if a partnership is concluded
- Ensure site security (prevention of abusive submissions via IP rate limiting)
- Meet our legal, regulatory and contractual obligations
4. Consent
By submitting a form on our site, you expressly consent to the collection and use of your information for the purposes described above. This consent is freely given, informed and provided for specific purposes, as required by Law 25.
You may withdraw your consent at any time by contacting our privacy officer (see section 1). Withdrawal of consent is not retroactive.
5. Disclosure to third parties
We never sell, rent or share your personal information with third parties for marketing purposes.
Your information is shared only with service providers who help us operate the site and process your requests. These providers are contractually required to protect your information and use it only for agreed-upon purposes:
- Vercel Inc. (website hosting, servers located in the United States)
- Resend, Inc. (form notification email delivery, operations in the United States)
- Business email provider for messages sent to info@thermik.ca
We may also disclose your information if legally required (subpoena, court order) or to protect our legitimate rights.
6. Transfer of information outside Quebec
Some providers mentioned above (Vercel, Resend) host or process your information on servers located in the United States. This means your information may be transferred outside Quebec and subject to the laws of the jurisdiction where it is hosted.
Before using these services, we evaluated their personal information protection practices and determined they provide adequate protection. These providers are subject to strict contractual obligations regarding security and confidentiality.
7. Retention period
We keep your personal information only for as long as necessary for the purposes for which it was collected:
- Unconverted quote requests: 3 years from the last communication
- Declined Thermik Pro applications: 1 year from the decision
- Active Thermik Pro partner files: duration of partnership + 7 years (accounting and legal obligations)
- Technical server logs (including IP addresses): maximum 90 days
At the end of these periods, your information is securely destroyed or irreversibly anonymized.
8. Security measures
We implement reasonable measures to protect your personal information from loss, theft, unauthorized access, disclosure, copying or modification:
- All communications with the site are encrypted via HTTPS (TLS)
- Access to information is limited to authorized personnel who need it
- Third-party providers selected based on recognized security practices
- IP-based submission rate limiting to prevent abuse
- No storage of personal information on unsecured devices
9. Your rights under Law 25
Law 25 grants you several rights regarding your personal information held by Thermik:
- Right of access: obtain a copy of the information we hold about you
- Right of rectification: have any inaccurate, incomplete or ambiguous information corrected
- Right to withdraw consent: withdraw your consent to the use or disclosure of your information
- Right to portability: receive your information in a structured, commonly-used technological format (as of September 22, 2024)
- Right to de-indexing: request that we stop disseminating your information if it causes you harm
- Right to be informed of any confidentiality incident presenting a serious risk of harm
To exercise any of these rights, contact our privacy officer (see section 1). We will respond within a maximum of 30 days.
11. Decisions based on automated processing
No decision regarding you (acceptance into the Thermik Pro program, pricing, etc.) is made in a fully automated manner. Each request is evaluated and processed manually by a member of our team.
12. Changes to this policy
This policy may be updated from time to time to reflect changes in our practices or in regulations. The date of the last update appears at the top of this page. We encourage you to review it periodically.
Any substantial modification will be communicated to you by an appropriate means if you have already interacted with us.
13. Complaints and remedies
If you believe Thermik has not respected your rights or its obligations regarding personal information protection, you may first file a complaint with our privacy officer (see section 1). If our response does not satisfy you, you may contact the Commission d'accès à l'information du Québec:
